About the Program
The 88th Texas Legislature passed Texas House Bill 998, expanding the role of the Texas FAIR Plan Association to include providing necessary property insurance to property owners’ associations in designated underserved areas.
The Texas Department of Insurance adopted new and amended sections to implement HB 998. See the Adoption Order. The adoption order outlines the petition process to have an area designated as underserved.
The Texas FAIR Plan Association has contracted with Arden Insurance Services to provide underwriting services for this program.
Coverage and Eligibility
Property owners’ association property must meet our eligibility requirements.
Important Definition from Insurance Code Section 2211.001
(6-a) "Property owners' association insurance" means property and liability insurance covering:
(A) common areas and facilities of a homeowners' association; or
(B) common elements of a condominium owners' association.

Designated Coverage Area(s)
Properties must be within the designated underserved areas, as determined by the Texas Department of Insurance commissioner. To petition TDI to designate an area as underserved, please see the adoption order.

If you are a registered agent with the Texas FAIR Plan Association and need to submit an application for Property Owners' Association (POA) insurance, please contact Arden Insurance Services at (800) 979-6437 or submit online.
Applications and all policy changes for POA insurance must be done over the phone or through the Arden Insurance Services’ Agent Portal. To register for access to the Arden Insurance Services' Agent Portal, please contact Arden Insurance Services at (800) 979-6437.
You cannot submit POA applications or policy changes in the TFPA Agent Portal.
